Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the TLD2 Chrome extension ("TLD2", "the Extension", "the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use TLD2.

These Terms constitute a legal agreement between you ("you", "User") and the TLD2 project ("we", "us", "our"). Your use of TLD2 is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Install and use TLD2 on Chrome or Chromium-based browsers
• Use TLD2 for personal, non-commercial purposes
• Access TLD2's features including content extraction, AI summarization, and text-to-speech

License Restrictions

You may NOT:

• Modify, reverse engineer, decompile, or disassemble TLD2 (except as permitted by open-source licenses)
• Distribute, sell, lease, or sublicense TLD2
• Remove or alter any proprietary notices, labels, or marks
• Use TLD2 for illegal purposes or to violate third-party rights
• Attempt to circumvent technical limitations or security measures
• Use TLD2 in a manner that could damage or impair functionality

3. Open Source Components

TLD2 incorporates open-source software components subject to their respective licenses:

• Readability.js - Apache License 2.0
• Kokoro TTS Model - Apache License 2.0
• ONNX Runtime Web - MIT License
• Transformers.js - Apache License 2.0

These components retain their original licenses. TLD2's proprietary code is provided under the terms of this agreement.

4. User Responsibilities

4.1 Lawful Use

You agree to use TLD2 only for lawful purposes and in compliance with all applicable laws, regulations, and third-party rights. You are responsible for:

• Ensuring you have rights to access and summarize content
• Respecting website terms of service and robots.txt directives
• Complying with copyright and intellectual property laws
• Not circumventing paywalls or access restrictions

4.2 API Key Management (Gemini Mode)

If you choose to use Gemini API mode:

• You are responsible for obtaining and securing your own Google Gemini API key
• You agree to comply with Google's Gemini API Terms of Service
• You are responsible for any API usage costs incurred
• You must keep your API key confidential and secure
• We are not liable for unauthorized use of your API key

4.3 Hardware Requirements

You acknowledge that TLD2's performance depends on your hardware capabilities:

• WebGPU support requires compatible GPU and drivers
• TTS synthesis performance varies by hardware
• We make no guarantees about specific performance metrics

5. Service Availability

5.1 "As-Is" Basis

TLD2 is provided free of charge on an "as-is" and "as-available" basis. We do not guarantee:

• Uninterrupted or error-free operation
• Compatibility with all websites or content types
• Accuracy of summaries or content extraction
• Continued availability of features or the Extension itself

5.2 Updates and Modifications

We reserve the right to:

• Modify, suspend, or discontinue TLD2 at any time without notice
• Update or change features, functionality, or requirements
• Remove or replace AI models or third-party integrations

5.3 Third-Party Dependencies

TLD2 relies on third-party services and models:

• Chrome AI Summarizer: Requires Chrome 120+ and availability varies by region
• Google Gemini API: Subject to Google's availability, rate limits, and terms
• Hugging Face Model Hosting: Model downloads depend on Hugging Face availability

We are not responsible for third-party service interruptions or changes.

6. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLD2 IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding accuracy, reliability, or quality of summaries
• Warranties that TLD2 will meet your requirements or expectations
• Warranties that TLD2 will be error-free, secure, or virus-free

You acknowledge that:

• AI-generated summaries may contain errors or omissions
• Content extraction may fail on certain websites
• TTS voices are synthetic and may have pronunciation issues
• You use TLD2 at your own risk

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF TLD2, INCLUDING BUT NOT LIMITED TO:

• Direct damages: Loss of data, system failures, or hardware damage
• Indirect damages: Lost profits, business interruption, or lost opportunities
• Consequential damages: Damages resulting from reliance on inaccurate summaries
• Incidental damages: Time wasted, inconvenience, or frustration

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Because TLD2 is provided free of charge, in no event shall our total liability exceed $10 USD.

8. Indemnification

You agree to indemnify, defend, and hold harmless TLD2, its developers, and contributors from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of TLD2
• Your violation of these Terms
• Your violation of third-party rights (copyright, privacy, etc.)
• Your use of Gemini API or other third-party services
• Your violation of applicable laws or regulations

9. Content and Intellectual Property

9.1 Website Content

When you use TLD2 to summarize web content, you acknowledge that:

• You must have rights or permission to access and process that content
• TLD2 does not grant rights to copyrighted content
• Summaries are for personal use unless otherwise permitted by content owners
• You are responsible for respecting copyright and fair use principles

9.2 AI-Generated Content

Summaries and TTS audio generated by TLD2:

• Are derivative works based on source content you provide
• May be subject to copyright claims from original content owners
• Are provided for personal, informational use
• Should not be redistributed or used commercially without proper rights

9.3 TLD2 Intellectual Property

TLD2's name, logo, interface design, and proprietary code are our intellectual property. You may not use our trademarks or branding without written permission.

10. Privacy and Data

Your use of TLD2 is subject to our Privacy Policy. Key points:

• Local AI Mode (Default): No data sent to external servers
• Gemini API Mode (Optional): Article text sent to Google's Gemini API
• Settings Storage: Stored locally in Chrome storage
• No Tracking: We do not collect usage data or analytics

11. Termination

11.1 Termination by You

You may terminate this agreement at any time by uninstalling TLD2 from your browser. All license rights cease upon uninstallation.

11.2 Termination by Us

We may terminate or suspend your access to TLD2 immediately, without notice, if you:

• Violate these Terms
• Use TLD2 for illegal activities
• Attempt to reverse engineer or exploit TLD2
• Cause harm to other users or our services

11.3 Effect of Termination

Upon termination:

• Your license to use TLD2 terminates immediately
• You must cease all use of TLD2
• Locally stored data remains on your device (see Privacy Policy for deletion)
• Provisions regarding warranties, liability, and indemnification survive termination

12. Geographic Restrictions

TLD2 is designed for global use but may have limitations:

• Chrome AI Summarizer: Availability varies by region and Chrome version
• Gemini API: Subject to Google's geographic restrictions
• Model Downloads: Require internet access to Hugging Face (initial download)

You are responsible for complying with local laws and regulations in your jurisdiction.

13. Export Compliance

TLD2 includes AI models and software that may be subject to export controls. You agree to comply with all applicable export laws and regulations. You may not use or export TLD2 to countries or entities prohibited by law.

14. Dispute Resolution

14.1 Informal Resolution

If you have a dispute with TLD2, please contact us at support@tld2.io to attempt informal resolution before pursuing legal action.

14.2 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

14.3 Arbitration

Any disputes arising from these Terms or TLD2 shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions or class arbitrations.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TLD2 regarding the Extension. These Terms supersede any prior agreements or understandings.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

19. Changes to Terms

We may modify these Terms at any time. Significant changes will be announced through:

• Updated "Last Updated" date at the top of this page
• Changelog entry at tld2.io/changelog
• Extension update notes (if applicable)

Continued use of TLD2 after changes constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must uninstall TLD2.
